(A) Purpose and intent. The purpose of this section is to regulate the use of roads and streets in the town by providing designated routes for commercial vehicle traffic. Establishing designated routes promotes efficiency and safety of the connecting street system and protects residential neighborhoods from commercial traffic. These restrictions are intended to preserve and enhance the character of the community, while protecting the health, safety, and general welfare of the town's residents.
(B) Definitions. For purpose of this section, the following term shall be defined as set forth below.
COMMERCIAL VEHICLE. A motor vehicle, truck, or semi-trailer having more than two axles, and designated or used for the transportation of goods, wares, merchandise, carrying freight, animals, or materials in the furtherance of any commercial enterprise.
(C) Applicability.
(l) The requirements of this section shall apply to all commercial vehicles as defined above, except for those specifically listed below:
(a) School buses and public transportation;
(b) Fire trucks and other emergency vehicles;
(c) Utility service vehicles or vehicles used for construction while in performance of that work;
(d) Road construction and maintenance equipment, so long as being used for that purpose.
(2) Commercial vehicles shall use or travel upon roads and streets designated by the town. Commercial traffic is permitted if the truck is traveling to a residence or a business to deliver or pick up goods, wares, merchandise, or providing services at a business or residence upon arrival. When commercial vehicles are traveling along a prohibited route, such travel is limited to the minimum necessary to accomplish the pickup, delivery, or service call, and said vehicle shall be driven in such a manner as to enter and leave the prohibited route as quickly as possible by the closest available truck route.
(3) Commercial vehicles may travel to their customary storage location, located along a route on which commercial traffic has been prohibited, only when the most direct route to and from a non-prohibited truck route is utilized.
(D) Designated commercial vehicle routes. Commercial vehicles are limited to the following routes within the town, unless otherwise provided in this section:
(1) US 70 Highway Business;
(2) US 70 Highway;
(3) NC Highway 42 East;
(4) NC Highway 42 West;
(5) Shotwell Road (SR 1553);
(6) Covered Bridge Road (SR 1700);
(7) Prichard Road (SR 1714).
(E) Penalty. The Clayton Police Department shall enforce the provisions of this section and may impose a $50 fine per infraction, in accordance with the provisions set forth in this Code of Ordinances. All fines are to be paid in accordance with the provisions set forth in § 10.99 of this Code of Ordinances.
