3-1-3: BUSINESS LICENSE REQUIRED:
   A.   It is unlawful to operate a business within the City without obtaining a business license prior to conducting business, unless otherwise exempt by City Code § 3-1-3(D).
   B.   A separate license must be obtained for each location at which the licensed activity is conducted.
   C.   All subcontractors shall be subject to this chapter and shall pay the license fee as provided in this chapter as their own business, and they are not privileged to operate under the prime contractor's license.
   D.   The following categories of businesses are exempt from the requirements to obtain a business license:
      1.   Any business exempt from the requirement to obtain a business license under the United State Constitution, Constitution of the State of Oregon, laws of the United States, or statutes of the State of Oregon;
      2.   Childcare providers;
      3.   Garage sales;
      4.   Adult assisted living facilities;
      5.   In-home adult care providers;
      6.   Insurance companies governed by Oregon Revised Statutes 731.840;
      7.   Landowners acting as general contractors for construction on their own property;
      8.   Newspaper carriers;
      9.   Nonprofit businesses;
      10.   Representatives of public utilities;
      11.   Suppliers and those engaged solely in wholesale selling to licensed retailers who do not have a place of business in the City;
      12.   The private sale of personal assets such as a personal automobile, residence, appliance, or other items;
      13.   Towing companies per Oregon Revised Statutes 822.230;
      14.   Farmer's market vendors;
      15.   The operation of a display space, booth, or table maintained for displaying or selling merchandise at any trade show, convention, festival, fair, circus, market, flea market, swap meet, or similar event for fewer than fourteen (14) days in any calendar year; and
      16.   Producers of farm products raised in Oregon, produced by themselves or their immediate families, who sell such products in the City by themselves or their immediate families.
   E.   Interpretation: The City Manager has the authority to determine if a specific business falls within a business license exception described under subsection (D) above. (Ord. 698, 8-5-2020, eff. 8-31-2020)
