(A) Purpose. The purpose of this section is to authorize the Police Department to establish a program for drug investigations and to authorize the use of funds for the undercover purchase of drugs (“buy money”) or as payment to informants, and to establish the method for expenditure of the funds.
(B) Drug Buy Fund. The Town Council establishes a Drug Buy Fund as allowed by IC 36-1-3. The Police Department shall follow the procedures for expenditures from the established fund as authorized by IC 36-1-8-3 and any amendments thereto.
(C) Appropriations. Appropriations for the Drug Buy Fund shall be made in the manner provided by Indiana statutes for other appropriations.
(D) Documentation. The Chief of Police or a designee shall document all expenditures made from the aforesaid Drug Buy Fund through procedures established and known as “Guidelines for Confidential Expenditures,” Appendix J, of the Indiana Criminal Justice Planning Agency Financial Guide. The Chief of Police shall monitor all revenues and expenditures of the Drug Buy Fund, and shall sign all requests for expenditure of funds from the Drug Buy Fund. A receipt shall be taken for each expenditure made from the fund. The Police Chief shall periodically file a voucher, with all original receipts totaling the cash claimed expended being attached to it, so that the fund can be reimbursed for expenditures from it. Reimbursement must be approved and made in the same manner as is required for other expenditures of the town.
(E) Revenue Sources. The Police Department for the town may fund the Drug Buy Fund through donations, court-ordered forfeitures to the Department, court-ordered confiscations to the Department, and other appropriate sources.
(F) Investment of Funds. The Clerk-Treasurer may, with the consent of the Chief of Police, invest any funds in the Drug Buy Fund in a money market account, certificate of deposit, or other secure investment. Any accrued interest from the investment of the funds from the Drug Buy Fund paid by any bank or other financial institution shall be deposited separately into the Drug Buy Fund and shall become a part of the fund.
(G) Initial Amount. The initial amount to be distributed to the Chief of Police to be used for the purposes of the Police Drug Buy Fund shall be $4,000.
