§ 96.01 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   PARK. All public parks having individual names.
   PERSON. Any person, firm, partnership, association, corporation, company, or organization of any kind.
   PROPERTY OWNER. Person owning such property as shown by the County Auditor's Plat.
   PUBLIC PLACES. All grounds owned by the town.
   PUBLIC TREES. All shade and ornamental trees now or hereafter growing on any street or any public areas where otherwise indicated.
   STREET. Entire width of every public way or right-of-way when any part thereof is open to the use of the public, as a matter of right, for purposes of vehicular and pedestrian traffic.
   STREET SUPERINTENDENT. Town official responsible for enforcement of the tree chapter.
   STREET TREES. Trees lying on real estate owned or controlled by the town, excluding the real estate owned or controlled by the Parks and Recreation Department and excluding real estate contained within public alleys.
   TOWN. The town of Clarksville, Indiana.
   TREE. Perennial plant having a woody supporting main stem or trunk, ordinarily growing to definite heights, and usually developing branches at some distance from the ground.
      (1)    LARGE TREE. Trees attaining a height of 45 feet or more.
      (2)    MEDIUM TREE. Trees attaining a height of 30 to 45 feet.
      (3)    SMALL TREE. Trees attaining a height of 20 to 30 feet.
   TREE CARE. Treating, spraying, removal, pruning, and any other tree maintenance or cultural work intended for the enhancement or preservation of trees and the removal and prevention of any and all damage to any street trees caused by pests, diseases, and the like.
   TREELAWN. Part of a street or highway, not covered by sidewalk or other paving, lying between the property line and that portion of the street or highway usually reserved for vehicular traffic.
