§ 116.20 FOOD VENDING VEHICLES.
   (A)   The following definitions apply throughout this subchapter.
      CATERING TRAILERS. A motorized wheeled vehicle or towed wheeled vehicle where food is prepared for consumption at a permitted event. CATERING TRAILERS shall be specifically designed and equipped to properly prepare and serve food.
      FOOD CART. A non-self-propelled mobile unit, not a vehicle or trailer, for selling food that is specifically designed for the preparation and handling of the food being sold (e.g., hot dog cart, popcorn cart).
      FOOD TRUCK. A motorized wheeled vehicle or towed wheeled vehicle where food is ordered, prepared within the food vending facility,
and sold on-site. FOOD TRUCKS shall be specifically designed and equipped to properly prepare and serve food.
      FOOD VENDING VEHICLE. Any mobile, wheeled vehicle or equipment from which food vending services are provided, including FOOD TRUCKS, ICE CREAM TRUCKS, CATERING TRAILERS, and FOOD CARTS.
      ICE CREAM TRUCK. A motor vehicle in which prepackaged food such as ice cream or other frozen desserts are carried for the purpose of retail sale.
   (B)   The following conditions apply to the operation of food vending vehicles.
      (1)   Food vending vehicles must obtain a permit from the town. Two types of permits shall be available: annual and temporary. Annual permits will be valid from January 1 to December 31 and cost $100. Temporary permits shall be used for a one-time setup or event, and the fee shall be $25.
      (2)   Food vending vehicles must be permitted and remain in compliance with Clark County Health Department regulations. Permits issued by the town shall be valid only while the business is in compliance with the Clark County Health Department.
   (C)   The following shall apply to property owned by the town.
      (1)   The town may designate certain town-owned properties as food truck sites and allow operation of food trucks on those properties for a certain amount of time.
      (2)   Food vending vehicle vendors seeking to operate on town property must be reviewed by the Technical Review Committee (TRC).
      (3)   Vendors operating on town property must have liability insurance in an amount sufficient for the town given the operation and location.
   (D)   The following shall apply to all food vending vehicles.
      (1)   Food vending vehicles may not operate beyond the hours of 6:00 a.m. to 10:00 p.m.
      (2)   If located on a property in or directly adjoining a residential zone, hours of operation shall not extend beyond 10:00 a.m. until 8:00 p.m.
      (3)   Hours of operation shall be agreed upon by the owner of the property where the food vending vehicle will be operating and shall be outlined in the permit
      (4)   Food vending vehicles may not operate as a drive-thru.
      (5)   If seating or tables are provided, they must be stored and secured during nonbusiness hours.
      (6)   Food vending vehicle operators shall be responsible for the proper disposal of any trash or waste produced as a result of their operation.
   (E)   When ice cream trucks are in operation, they shall remain in one location no longer than 15 minutes. If an ice cream truck operation exceeds this time limit, they shall be subject to the rules for food trucks found elsewhere in this subchapter. When parked, they shall do so in a location in which parking is allowed.
   (F)   Catering trailers may be permitted as part of a temporary event as per § 150.250, of the zoning code but shall otherwise adhere to the regulations in this subchapter regarding food trucks. Catering trailers may operate only as long as the event to which they are attached.
