(A) The Hearing Authority may revoke or suspend an electrical contractor's license, mechanical contractor's license, or licensed plumbing contractor registration issued under this chapter for just cause, including, but not limited to:
(1) The application or supporting documents contain a false statement or misrepresentation as to a material fact;
(2) The contractor's lack of compliance with building rules, standards or procedures;
(3) Failure to comply with this chapter; or
(4) Failure to comply with Chapter 150 of the Clarksville Municipal Code.
(B) The Hearing Authority, upon receipt of written documentation from the enforcement authority recommending revocation or suspension, shall provide written notification to the contractor of the reason for revocation or suspension and the date and time the contractor is to appear for a hearing on said revocation or suspension by a manner of serving notice set forth in IC 36-7-9-25.
(C) If, after the hearing, the Hearing Authority is satisfied that the weight of the evidence clearly indicates the violation alleged in the notification of hearing occurred, the Hearing Authority may revoke or suspend the license and/or certification registration.
(D) The Hearing Authority is hereby authorized to order the contractor to make correction to correct defects and/or deficiencies or the make necessary modification to ensure compliance with the adopted rule of the Fire Prevention and Building Safety Commission and this chapter.
(E) When authorizing a contractor to make corrections, the Hearing Authority shall establish a date that all defects, deficiency and/or code violations are to be corrected.
(F) If a property owner prevents a contractor from correcting defect and/or deficiencies by the established date, the Hearing Authority may reinstate said license and/or certificate of registration.
