§ 100.08 WRITTEN NOTICE OF APPROVAL OR DENIAL.

   (A)   In a written notice issued under this chapter, the Authority shall state clearly the basis for its decision to approve or deny an application. If the permit authority denies an application, the written notice must cite substantial evidence in support of the denial.

   (B)   For purposes of this section, a notice is considered written if it is included in the minutes of a public meeting of the Authority.

   (C)   If the Authority fails to act on an application within the applicable deadline as described in §§ 100.06(D) or 100.07(D) or as otherwise described in this chapter, the application is considered approved.
