(A) If the town has reasonable cause to believe that any private residential swimming pool does not meet the operational requirements of this chapter, the Building Commissioner is authorized to inspect the conditions in and around such swimming pools where visible from public property. The Building Commissioner shall otherwise be entitled to seek and obtain an inspection warrant for such inspections from the Clark Circuit Court in accordance with the provisions of IC 36-7-9-16.
(B) If the Building Commissioner finds that the operation of the pool does not meet the applicable requirements of this subchapter, the Building Commissioner may direct that the pool be closed until such time as the requirements of this subchapter are met.
