§ 150.206 POOL CONSTRUCTION.
   (A)   Private residential swimming pools shall be constructed of impervious materials which will provide a tight, smooth, and leakproof tank.
   (B)   Permanent private residential swimming pools shall be engineered and designed to comply with applicable provisions of the Building Code of the town, as amended, where not in conflict with this subchapter.
   (C)   Temporary private residential swimming pools shall be engineered and designed to withstand all anticipated forces of nature to which it is likely to be subjected.
   (D)   Wood is prohibited from being used at, above, or below grade as an integral part of the pool structure.
   (E)   Underwater lights shall be equipped with a grounded deck junction box. An independent, bare copper ground wire of an approved type shall be connected to an approved grounding terminal. All materials, including the entire electrical fixture, shall be listed by Underwriters Laboratories for this class of service and installed in accordance with NEC standards.
   (F)   There shall be one or more means of egress in the form of steps, ladders, or step holes in each pool; provided, however, that the means of egress into all temporary pools may be removable.
   (G)   Swimming pool heaters and boilers, when installed, shall comply with applicable requirements of the NEC, the American Standards Association (ASA); American Gas Association (AGA); American Society of Mechanical Engineers (ASME); Underwriters Laboratories; or other nationally recognized testing agencies.
   (H)   Unless authorized by the official action of the Town Council and/or the Board of Zoning Appeals, as applicable, all private residential swimming pools shall be completely enclosed by a fence at least five feet in height, but not more than six feet in height, with a self- locking gate meeting the standards specified in the Article 4, § 157-80, of the Zoning Ordinance. This provision does not apply to pools constructed or installed before September 1, 2017.
   (I)   All permanent in-ground private residential swimming pools shall have a walkway not less than 30 inches in width extending entirely around and abutting the perimeter of the pool. Grading of the pool area shall be such as to avert surface water drainage from entering the pool.
   (J)   All in-ground pools shall be bonded in accordance with NEC standards and inspected by the Building Commissioner.
   (K)   The Building Commissioner may recommend such other construction standards as deemed necessary or advisable by related conditions upon issuance of each permit.
   (L)   The receptacle or breaker and the entire unit shall be GFCI and grounded with two driven ground rods.
   (M)   All pool installations must comply with the town’s Zoning Ordinance setback requirements for accessory structures. These include primary, rear, and side property lines, and distances from the primary structure, garage, or other accessory structure(s).
