(A) No person shall construct, erect, or alter a private residential swimming pool without first having obtained permission from the Planning Department and received a building permit issued and signed by the Building Commissioner after having paid the applicable fee.
(B) Application for a permit shall be in writing on such form as shall be made available by the town. Such application shall describe the proposed work or structure and shall contain such information, drawings, plans, and specifications as are prescribed herein. The application shall be made by the owner or lessee, or authorized agent of either, or the architect, engineer, or builder employed in connection therewith. Such application shall contain the full names and addresses of the applicant and of the owner or lessee, or the authorized agent of either, and if the applicant is a corporate entity, its responsible officers.
(C) Where pumps or other ancillary electrical equipment are installed, a separate electrical permit shall be obtained. All equipment and electrical services are required to be installed by a licensed electrician registered by the town and in accordance with Chapter 42 of the 2012 International Residential Building Code and the NEC.
(D) It shall be a condition of each building permit issued in accordance with this subchapter that the owner(s) or occupant(s) of any property on which a residential pool is located shall permit the Building Commissioner to enter the property to inspect the pool on request at any time between the hours of 8:00 a.m. and 5:00 p.m. An owner’s denial of access shall be cause for the issuance of an inspection warrant by the Clark Circuit Court in accordance with the provisions of IC 36-7-9-16.
