§ 131.07 DEFINITIONS; PUBLIC INTOXICATION.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      ALCOHOLIC BEVERAGE. A compound produced and sold for human consumption as a drink that contains more than 0.5% of alcohol by volume.
      BEER. An alcoholic beverage made by the fermentation of an infusion or decoction, or a combination of both, in potable brewing water, of malted barley with or without hops or their parts or their products, and with or without other malted cereals, and with or without the addition of unmalted or prepared cereals, other carbohydrates, or products prepared therefrom, and with or without other wholesome products suitable for human food consumption, containing not more than 7% of alcohol by weight.
      LIQUOR. An alcoholic beverage except beer and table wine.
      PUBLIC DISPLAY OR EXHIBITION OF ALCOHOLIC BEVERAGES. Includes the carrying or exhibiting of open cans or bottles of alcoholic beverages, or the carrying or exhibiting of glasses or other types of containers, either empty or containing alcoholic beverages, within a public place, and shall also include the carrying, exhibiting, or transporting of such in, or on, vehicles, but does not include carrying or transporting alcoholic beverages in sacks, cases, boxes, cartons, or other similar containers that conceal the contents, provided such alcoholic beverage has not been opened and seals have not been broken; it further does not include the collection and transportation of empty containers for salvage or refuse collection purposes in portions of vehicles not used for passenger purposes.
      PUBLIC DRINKING. Includes the drinking or consuming of alcoholic beverages in any public place as defined herein.
      PUBLIC PLACES. Includes all streets, avenues, alleys, parks, parking lots, and sidewalks, and does not including the inside of any building, within the town.

   (B)   Public drinking and public display or exhibition of alcoholic beverages, as defined herein, are hereby prohibited, and it shall be unlawful and a misdemeanor for any person to engage in public drinking and to engage in any public display or exhibition of alcoholic beverages within the town limits, except in or on those establishments having a license to dispense alcoholic beverages.
