(A) No person shall encumber any street or sidewalk. No owner, occupant, tenant, person, and/or any other entities of any kind having the care of any building or lot of land bordering on any street or sidewalk, shall permit the same to be encumbered with barrels, boxes, cans, electrical appliances, articles, or substances of any kind, so as to interfere with the free and unobstructed use thereof.
(B) Exceptions to the prohibition of encumbering any street or sidewalk referred to in division (A) above are as follows:
(1) Businesses may place display items or items for sale in an area not to exceed 48 inches measured from the front of the related building or structure, and in a manner so as not to interfere with no less than 60 inches of free and unobstructed use of the sidewalk.
(2) Businesses may place a non-advertising bench for temporary seating within the guidelines set forth in division (A). Benches may not be used for the purpose of additional seating for any business.
(3) Further exceptions may be considered by application through a committee composed of the following department heads: the Chief or his designee of the Cicero Police Department, the Chief or his designee of the Cicero Fire Department, the Building Commissioner or his designee of Cicero/Jackson Township Planning Department, and the Superintendent of the Cicero Utilities.
(4) No exception to this section shall contradict nor supersede any existing ordinance in the Town of Cicero/Jackson Township Building and Zoning Code.
(5) Furthermore, any exceptions to this section by the above-mentioned committee must take into consideration the health, safety, and welfare of the town residents as well as all pedestrian traffic which may walk on, go over, and utilize for any purposes the said street or sidewalk.
