202.99 CODE VIOLATION PENALTIES.
   Effective immediately upon approval and passage of this section in accordance with law, the following penalties shall apply to each and every violation of the Codified Ordinances of the City of Christopher, with the exception of violations of Section 604.04 of the Codified Ordinances of Christopher, said section having its own penalty provisions and being titled "Seizure and Impoundment of Motor Vehicles Used in Commission of Certain Criminal Offenses." With the exception of Section 604.04, this Section 202.99 is specifically intended to supersede any and all other penalty provisions within this Code, regardless of the specificity of any such other penalty provisions, which are hereby declared moot and repealed:
   (a)   First Offense. Upon receiving a citation alleging a violation of any City of Christopher ordinance, the individual cited shall have the opportunity to pay the total amount of seventy-five dollars ($75.00) at Christopher City Hall within 30 days of the date the citation was issued in full settlement of the alleged violation. If the cited individual does not pay seventy-five dollars ($75.00) within 30 days, the citation will be forwarded to the City Attorney and prosecuted pursuant to (b) below.
   (b)   Second Offense and Unpaid First Offense. Upon issuance of a citation alleging a second violation of any City of Christopher ordinance within the same calendar year, including any violation of substantially similar ordinances within the same calendar year by the same individual, the City shall have the discretion of forwarding the citation to the City Attorney for prosecution through the Franklin County Circuit Court; and the minimum fine shall be one hundred fifty dollars ($150.00) plus court costs and attorney fees. The same minimum fine of one hundred fifty dollars ($150.00) shall apply to unpaid first offenses described in (a) above.
   (c)   Third Offense. Upon issuance of a citation alleging a third violation of any City of Christopher ordinance within the same calendar year, including any violation of substantially similar ordinances within the same calendar year by the same individual, the City shall have the discretion of forwarding the citation to the City Attorney for prosecution through the Franklin County Circuit Court; and the minimum fine shall be three hundred dollars ($300.00) plus court costs and attorney fees.
   (d)   Fourth Offense. Upon issuance of a citation alleging a fourth violation of any City of Christopher ordinance within the same calendar year, including any violation of substantially similar ordinances within the same calendar year by the same individual, the City shall have the discretion of forwarding the citation to the City Attorney for prosecution through the Franklin County Circuit Court; and the minimum fine shall be seven hundred fifty dollars ($750.00) plus court costs and attorney fees.
   (e)   Separate Violations. A separate offense shall be deemed committed each day on which a violation or noncompliance occurs of continues, regardless of whether or not multiple citations are issued for each day a violation continues.
