§ 51.255 OTHER USER CHARGE PROVISIONS.
   (A)   Biennial review. The Finance Director will review the wastewater contribution of users and user classes, the total costs of operation and maintenance of the treatment works, and its approved user charge system. The Finance Director shall at such time recommend a revision in the sewer service charge and user classes to accomplish the following:
      (1)   Maintain a reasonable proportionate distribution of operation and maintenance costs among users and user classes;
      (2)   Generate sufficient revenue to pay the total operation and maintenance costs necessary to the proper operation and maintenance (including replacement) of the treatment works; and
      (3)   Generate sufficient funds to support a capital improvement plan (C.P.) as approved by Council.
      (4)   Apply excess revenues collected from a class of users to the costs of operation and maintenance attributable to that class for the next year and adjust the rate accordingly.
   (B)   Inconsistent agreements. The user charge system set forth in this chapter is applicable to all agreements or contracts between the town and users including industrial users, other municipalities or federal agencies or installations, and the terms of this chapter shall take precedence over any such agreements or contracts which are inconsistent with the requirements of this chapter.
   (C)   Wastewater treatment byproducts. All revenue from the sale of treatment-related byproducts, except recharged effluent, shall be used by the town to offset the cost of operation and maintenance and C.P. User charges shall be proportionally reduced for all users. Total annual revenues received from the sale of a byproduct shall be credited to the treatment works O&M cost no later than the fiscal year immediately following their receipt.
