§ 51.216 PERMITTEE SHALL NOTIFY TOWN OF ACCIDENTAL DISCHARGE.
For counter-measures to be taken by the town to minimize damage to the sanitary sewer system and/or receiving waters, the permittee shall notify the town immediately upon accidentally discharging wastes in violation of this chapter. This notification shall be followed by a written statement, within 3 days of the date of the discharge or the discovery thereof, describing the nature and quantity of regulated wastes discharged, causes of the accidental discharge, any action taken to mitigate the discharge and the measures being taken to prevent a future occurrence. The notification will not relieve permittee of liability for any expense, loss or damage to the sanitary sewer system, any clean up, mitigation measures, or for any fines imposed on the town on account thereof and/or for any enforcement action pursuant to this occurrence.
