§ 33.09 LIABILITIES.
   (A)   This chapter is an exercise by the village of its governmental functions of the protection of the public peace, health, and safety, and neither the village nor agents and representatives of same, or any individual, receiver, firm partnership, corporation, association or trustee, or any of the agents thereof in good faith carrying out, complying with or attempting to comply with any order, rule or regulation promulgated pursuant to the provisions of this chapter, shall be liable for any damage sustained to persons or property as the result of said activity.
   (B)   Any person owning or controlling real or personal property who, under this chapter, voluntarily or involuntarily, knowingly or unknowingly, with or without compensation, grants a license or privilege or otherwise permits or allows the designation or use of the whole or any part or parts of such real or personal property for the purpose of sheltering, protecting, safeguarding or aiding in any way persons shall, together with the successors in interest, if any, not be civilly liable for the death of or injury to any person or the loss of or damage to the property of any persons here such death, injury, loss or damage resulted from through or because of the use of the said real or personal property for any of the above purposes.
