§ 155.216 APPLICATION PROCEDURE.
   (A)   (1)   All applications for a special use permit shall be addressed and submitted to the Zoning Administrator. Applications for special use permits shall be made on the proper form obtainable from the Zoning Administrator and shall include the following information:
         (a)   A site plan, drawn to a scale of at least 1 inch to 40 feet, indicating the property lines of the parcel upon which the use is proposed; the identity of neighboring properties; any adjacent public or private streets; any existing or proposed structures, showing setbacks to abutting rights-of-way and property lines; parking areas, showing the number and arrangement of parking spaces and driveway entrances; abutting and on-site utilities; surface water drainage; and significant natural features. The site plan shall be neatly drawn and indicate north point, name and address of the person who prepared the plan, date of the original drawing and an account record of any later revisions.
         (b)   Building and floor elevations, which shall include flood elevations if the site is located in a floodplain; a floor plan, indicating dimensions of the building, gross floor space; and any other applicable information.
         (c)   A complete and detailed description of the use proposed, together with any other pertinent information which the applicant feels would be helpful to the Village Council in considering the application.
         (d)   A plan showing the size, type, lighting (if any) and location of any signage proposed to be erected in conjunction with the use.
      (2)   Some of the required information to be submitted may be waived by the Zoning Administrator at the time of submission as may be applicable, such as for changes of use in existing buildings involving no expansions, and the like.
   (B)   Upon receipt of a complete application for a special use permit by the Zoning Administrator, and after review by the Planning Board, the Village Council shall, within 45 days, call a public hearing and shall give notice as required by law. At the hearing, the applicant or designated representative thereof shall appear for the purposes of offering testimony and recommendations as to the application. In addition, the Council shall allot reasonable time for the expression of views by any member of the public attending the meeting in person or represented by an attorney.
   (C)   (1)   The Village Council shall grant and issue the special use permit if and only if it finds the following:
         (a)   The use will not materially endanger the public health or safety if located where proposed and developed according to the plan as submitted and approved;
         (b)   The use meets all required conditions and specifications;
         (c)   The use will not substantially injure the value of adjoining or abutting property or, in the alternative, the use is a public necessity; and
         (d)   The location and character of the use, as developed according to the plan as submitted and approved, will be in harmony with the area in which it is to be located and in general conformity with the plan of development of the village and its environs.
      (2)   If, in the opinion of the Village Council, any 1 of the above conditions has not been met, the Council shall deny the application.
   (D)   The Zoning Administrator shall inform the applicant or representative within 15 days after the final decision of the Village Council of the Council's ruling, either granting, granting with conditions or denying the special use permit.
