§ 155.174 SETBACKS REQUIRED.
   (A)   Setback required. Every new structure or addition to an existing structure, either permanent or temporary in nature, shall be provided with setbacks in accordance with the provisions of this section and with the Code of Ordinances.
   (B)   Location of required setbacks. Any new structure or addition to an existing structure, either temporary or permanent in nature, constructed or erected adjacent to Highways US64/US74A/NC9 may not be placed closer than 28 feet to the pavement edge of Highways US64/US74A/NC9; unless this provision is waived by the Village Council.
   (C)   Parking spaces required; commercial structures.
      (1)   Every new commercial structure, either temporary or permanent in nature, erected on property located immediately adjacent to Highways US64/US74A/NC9, after the effective date of this section, shall be required to provide off-street parking facilities adjacent to the Highways US64/US74A/NC9, to the maximum extent practical for the needs of its occupants, employees, guests, invitees, visitors or patrons; unless this provision is waived by the Village Council. Parking spaces shall not be less than 9 feet in width and 18 feet in length. The requirement to provide parking spaces shall not be construed to require the owner or lessee of any property to provide public parking facilities on private lands.
      (2)   Any existing structure that is changed to a commercial use from a non-commercial use after the effective date of this section must comply with the provisions of this section, unless this provision is waived by the Village Council.
      (3)   A plan for parking facilities shall be submitted to and approved by the Village Council or its designee prior to the issuance of a building permit and/or the placement of any commercial structure.
