§ 154.083 SEDIMENTATION CONTROL.
   In order to prevent soil erosion and sedimentation pollution of streams, springs, flat water bodies or other drainage networks, and when there are plans for a land disturbing activity of 1 acre or more, the subdivider shall show proof with the preliminary plat that an erosion and sedimentation control plan has been submitted to and approved by the state agency having jurisdiction (the Division of Land Resources of the Department of Environment, Health and Natural Resources as of the date of adoption of this chapter) in accordance with the North Carolina Administrative Code Title 15, as adopted by the North Carolina Sedimentation Commission, January 11, 1978, as amended.
