§ 150.56 EXEMPTIONS.
   (A)   Land disturbing activities conducted by the following agencies shall be exempt from the provisions of this subchapter:
      (1)   The State of North Carolina;
      (2)   The United States; and
      (3)   The Village of Chimney Rock, except that the village hereby declares its intent that all of its departments, contractors and subcontractors shall also comply with the regulations set forth in this subchapter.
   (B)   Re-grading and similar maintenance of existing roadways;
   (C)   Agricultural tilling and similar agricultural uses; and small home gardening plots, providing that the use is not closer than 50 feet to a water body;
   (D)   Activities undertaken on forest land for the production and harvesting of timber products conducted in accordance with best management practices set out in Forest Practice Guidelines Related to Water Quality; and
   (E)   The removal of dead or diseased trees.
