(A) The Zoning Administrator, after a review of the plans and specifications submitted with an application for a Zoning Ordinance compliance/land disturbance permit, may determine, due to the complexity of the proposed project, that a foundation survey is required prior to construction of any portion of a new structure, or an addition to an existing structure, that will be located within 5 feet of any required yard setback.
(B) The required survey shall be prepared by a registered land surveyor or civil engineer shall be made to insure that the proposed structure will be located as shown on the approved plans. This survey shall be conducted after the corners of the structure are staked out, but prior to construction of any footer, foundation, or post. The survey shall also indicate the location of proposed roof overhangs, decks, chimneys and any other proposed appurtenances that extend beyond the walls of the structure.
(C) This survey shall be submitted to the Zoning Administrator for review and, if in accord with the approved plans, the Zoning Administrator shall issue a statement of setback approval. This statement shall be required before any certificate of occupancy shall be issued by the Rutherford County Building Inspections Office. If the survey is not performed, or if the survey shows the structure is not in accord with the approved plans, the Zoning Ordinance compliance/land disturbance permit shall be rescinded until the time as a survey shows the location of the structure is in conformance.
(D) In the event the certificate of zoning compliance is rescinded, the Zoning Administrator shall notify the Rutherford County Building Inspections Office that the building permit is no longer valid.
