§ 130.04 NO SMOKING PERMITTED IN PUBLIC AREAS.
   (A)   It shall be unlawful for any person to smoke, burn or use any tobacco product within any building or facility owned, leased, occupied, managed, controlled and/or exclusively operated by the municipality of Chimney Rock Village, except in designated smoking areas. The Village Council shall have the authority to designate smoking areas within each municipal building or facility. An area within a building or facility may be designated as a smoking area only if the ventilation of the area is sufficient that any adverse impact on municipal employees and members of the public is minimal, and no fire or other safety hazard will be created by smoking in the area.
   (B)   It shall be unlawful for any person to smoke, burn or use any tobacco product within any vehicle now or hereafter owned or leased by the municipality of Chimney Rock Village.
   (C)   This section controlling tobacco use shall not apply to the following:
      (1)   Police or law enforcement vehicles; and/or
      (2)   Fire Department or emergency management vehicles.
   (D)   Violation of this chapter shall constitute a misdemeanor punishable in accordance with G.S. § 14-4.
