§ 90.02 REGULATION OF DOGS.
   (A)   No person in the city shall violate any order or regulation of the Hamilton County District Board of Health pertaining to the antirabic vaccination of dogs, obstruct or interfere with the execution of such order or regulation, or willfully or illegally omit to obey such order or regulation.
   (B)   (1)   All dogs over four months of age and present within the city must be validly licensed through the Hamilton County Auditor. Any person having ownership or control of a dog over the age of four months shall be responsible for obtaining such license for the dog. It shall be prima facie evidence that a person has ownership or control over a dog if that dog is present at the person’s residence of place of business.
      (2)   Each day of violation of this division may be considered a separate and new offense.
   (C)   (1)   No person shall permit more than five dogs to be present at any one time at a residence or place of business within the city. The limitation of five dogs shall not include newly born dogs until they reach the age of six months. The limitation of five dogs may be exceeded when all such dogs are necessary for the assistance of handicapped or sight-impaired persons. However, when the five dog limitation is exceeded in such circumstances, no more than one day may be present for each handicapped or sight-impaired person. The limitation of five dogs shall not apply to a pet grooming business or to a pet retailing business which is validly licensed and operating within the business district of the city.
      (2)   Each day of violation of this division may be considered a separate and new offense.
   (D)   (1)   A KENNEL shall be defined as any location in which the person in control breeds or boards dogs, whether overnight or throughout the course of the day, for profit or for gain. All persons operating a kennel within the city must be validly licensed through the Hamilton County Auditor, and must register the kennel with the auditor of the city.
      (2)   Each day of violation of this division may be considered a separate and new offense.
