§ 164-34 APPEAL.
   (A)   Any user, permit applicant, or permit holder affected by any decision, action, or determination, including cease-and-desist orders, made by the Director of Public Works interpreting or implementing the provisions of this article or in any permit issued under this article, may file with the Director a written request for reconsideration within ten days of the decision, action, or determination, setting forth in detail the facts supporting the user's request for reconsideration.
   (B)   (1)   If the ruling made by the Director is unsatisfactory to the person requesting reconsideration, the person, within ten days after notification of the Director's action, may file a written appeal to the Town Council. The written appeal shall be heard by the Council within 30 days from the date of filing. The Council shall make a final ruling on the appeal within 30 days of the close of the meeting.
      (2)   The Director's decision, action, or determination shall remain in effect during the period of reconsideration.
