§ 134-3 CHIEF OF POLICE.
   (A)   Appointment. The Chief of Police shall be appointed by the Mayor and confirmed by a majority vote of the Town Council in accordance with the provisions of the Town Charter. The Police Chief’s compensation shall be determined by the Town Council.
   (B)   Powers and duties. The Chief of Police shall be accountable to the Town Manager and the Mayor and Council, subject to their supervision and control, and shall have the following duties:
      (1)   Administer the day-to-day affairs of the Department;
      (2)   Have general authority and control over all departmental staff and oversee the proper fulfillment of all tasks and duties assigned to the Department;
      (3)   Prescribe personnel and administrative rules and regulations as he or she deems necessary or expedient for the proper operation of the Department and, to that end, keep himself or herself informed of the latest administrative practices. The rules and regulations shall be subject to the approval of the Town Manager and the Town Council;
      (4)   Recommend personnel promotions and new candidates for hiring to the Town Manager and Town Council for their action;
      (5)   Make monthly or more frequent reports on matters affecting or reflecting upon the Department to the Town Council;
      (6)   Prepare an annual budget request for the Department and submit it to the Town Manager for ultimate review and approval of the Town Council;
      (7)   Attend monthly meetings of the Town Council and other meetings as directed by the Town Manager or Town Council;
      (8)   Be responsible for the administration, training, discipline and morale of the personnel of the Department and the maintenance of all property and equipment of the Department. The Police Chief shall have such authority as may be necessary to perform his or her duties and fulfill his or her responsibilities in an efficient and lawful manner consistent with state law, the Town Charter, this Code or other ordinances of the Police Department; and
      (9)   Issue operational orders and special orders consistent with state law, this Code or other ordinances or approved departmental rules and regulations, which shall have the same force and effect as rules and regulations of the Town Council.
