3-9-4: PROHIBITIONS:
   A.   Smoking shall not be permitted anywhere in the establishment.
   B.   Eating shall not be permitted in the immediate area of the premises where body art is being performed.
   C.   No person may perform body art procedures while under the influence of alcohol or nonmedically prescribed drugs.
   D.   No person may perform body art procedures upon any person who is or appears to be under the influence of drugs or alcohol or who is or appears to be incoherent for any reason.
   E.   Offering or soliciting to perform body art on body of a person under the age of eighteen (18) who is not accompanied by a parent or legal guardian is prohibited.
   F.   Performing body art on a person under the age of eighteen (18) without the parent or legal guardian being present and giving written consent is prohibited. The written consent form shall be signed in the presence of an owner or employee of the establishment and shall include the disclosure required by section 797.400(1) of the Body Art Code and 720 Illinois Compiled Statutes 5/12C-40(a)(1) of the Illinois Criminal Code, or any amendments thereof.
   G.   Owners, employees and other agents of any establishment performing body art may not permit a person under eighteen (18) years of age to enter or remain on the premises where body art is being performed unless the person under eighteen (18) years of age is accompanied by his or her parent or legal guardian.
   H.   This section should not be construed in any way to prohibit the performance of medical or dental procedures performed by a licensed healthcare professional or other person authorized to perform that procedure, or prohibit the presence of a person under eighteen (18) years of age who is not accompanied by a parent or legal guardian on the premises of where medical or dental procedures are performed.
