(A) Every tattoo or body piercing establishment shall be equipped with sterilizing equipment prescribed by the public health director or his duly authorized representatives or as otherwise provided by law or ordinance. The sterilizing equipment must be maintained in proper sanitary manner and be at all times in proper working order. No tattooing and/or piercing shall be performed unless the tattooing and/or piercing equipment and materials have been sterilized before attempting to tattoo and/or pierce each customer.
(B) An individual shall not tattoo or perform body piercing on a minor unless the individual obtains the prior written informed consent of the minor's parent or legal guardian. The minor's parent or legal guardian shall execute the written informed consent in the presence of the individual performing the tattooing or the body piercing on the minor or in the presence of an employee or agent of that individual.
(C) An individual shall not tattoo or perform body piercing on another individual if the other individual is under the influence of intoxicating liquor or a controlled substance.
(D) All individuals tattooing or performing body piercing must possess qualifications either by experience and/or training or otherwise provided by law.
(E) All unreasonable materials used during the administration of tattooing or body piercing which comes in contact with the individual being tattooed or body pierced must be disposed of by a licensed medical waste handler in compliance with state and local laws for disposal.
(F) All applicants must provide insurance in a minimum amount of $250,000 in effect for no less than one year or the term of each license.
(G) Needles, dyes, inks and other materials or other equipment used in tattooing or body piercing shall be kept in a clean, sterile, non-toxic condition and the environment of the premises shall be such as to prevent transmission of etiologic agents. Violation of this provision is hereby declared detrimental to health and dangerous to human life and shall be considered a nuisance.
(H) The individual administering tattoos or body piercing must advise the customer to seek medical attention if the tattoo site or body piercing site becomes infected, painful or if a fever develops.
(I) All individuals administering a tattoo or body piercing must have smooth, easy-to-clean counter surfaces and they must sterilize re-usable needles.
(J) All individuals administering a tattoo or body piercing also must wear disposable gloves and give customers information sheets on what to do if the area being tattooed or pierced becomes infected.
(K) All applicants' place of business must be approved by the State Health Department to assure all state laws are complied with.
