(A) Civil penalties. Any person who violates any provision of this chapter shall be subject to a civil penalty of $100. Each 24-hour period, defined as 12:00 midnight to 11:59 p.m. of a continuing violation, shall constitute a separate offense under this chapter. The County Manager shall assess civil penalties under this chapter and shall make written demand for payment upon the person responsible for the violation. If payment is not received or equitable settlement reached within 60 days after demand for payment is made, the matter may be referred to the County Attorney for institution of a civil action in the name of the county in the appropriate division of the General Court of Justice for recovery of the penalty.
(B) Criminal penalties. Any person who violates any provision of this chapter which is specifically designated as a misdemeanor shall be a Class 3 misdemeanor and any person convicted of the violation shall be punishable as provided in G.S. § 14-4, or a fine not to exceed $500 in accordance with G.S. § 153A-123, or both. Each day of a continuing violation shall constitute a separate offense under this chapter.
