§ 35.059 COMPENSATORY TIME.
   Employees not exempt under the Fair Labor Standards Act are eligible for compensatory time. Employees may accumulate a maximum of 60 hours, and may carry 20 hours to the following calendar year. Employees not exempt under the Fair Labor Standards Act shall be compensated for all hours not eligible to be carried forward. Employees not exempt under the Fair Labor Standards Act may elect compensatory time in lieu of overtime compensation. Compensatory time shall be scheduled and approved by the Department Head at least one week in advance, except in the case of emergency call outs where the employee utilizes the compensatory time the following day. In all cases, the employee shall notify his or her department head of their intent to utilize compensatory time.
