§ 115.03 POLICE DEPARTMENT UTILITY TAX FUND.
   (A)   There is hereby established in the village treasury a designated special fund to be known as the Police and Public Works Utility Tax Fund. Twenty percent of all taxes imposed by the village pursuant to Chapter 116 with respect to telecommunications receipts after May 1, 2006, shall be placed by the Village Treasurer in such fund, which shall be segregated from all other funds of the village.
   (B)   Annually, as part of the village appropriation ordinance, the funds in the Police Department Utility Tax Fund shall be appropriated for Police Department expenditures and no other purposes. Police Department expenditures may include, but are not limited to, the following expenditures with respect to the Police Department:
      (1)   Police Department vehicles and equipment; and
      (2)   Capital improvements.
   (C)   Funds in Police Department Utility Tax Fund may be appropriated and expended for purposes other than those set forth in division (B) of this section only with a majority vote of the corporate authorities of the village then in office.
   (D)   Nothing in this section shall be construed as limiting additional appropriations of, or and expenditures by, the General Fund for the purposes enumerated in division (B) of this section.
