§ 58-91 AUTHORITY TO ORDER CONSTRUCTION; SUPERVISION.
   (A)   The City Council, whenever it shall deem it necessary, may authorize and order the construction or repair of any sidewalk in the public streets and alleys of the city at city expense and the city may employ a contractor to construct or repair such sidewalk.
   (B)   It shall be the responsibility of property owners to replace or repair damaged sidewalk resulting from any action of the property owner, including such activities as contracted work on their property.
   (C)   If any person shall fail to comply with the provisions of division (B) of this section by the specified time, the City Manager shall, through the Department of Public Works, cause such damaged sidewalks to be repaired or replaced. The Director of the Department of Public Works shall cause the owners of property on which the sidewalks have been repaired or replaced to be billed for all costs and expenses incurred by the city for the repair or replacement.
   (D)   Failure of the property owner to pay these costs and expenses within 60 days after billing shall result in said costs and expenses being placed on the tax roll of the involved property as provided by law.
   (E)   Sidewalks shall be constructed or repaired under the supervision and direction of the Director of Public Works on the established grade as ascertained, determined and furnished by him.
