(A) Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
(B) Each person guilty of violating §§ 91.02 through 91.06 of this code, including but not limited to maintaining a public nuisance, shall be fined in an amount of not less than $150 and not more than $2,500. The amount of fines imposed shall be at the discretion of the city’s enforcement officer. A determination that a person has violated §§ 91.02 through 91.06 of this code may be appealed as provided in § 91.07 of this code.
(D) (1) First violation. Any person or entity in violation of §§ 91.35 through 91.38 of this code may be fined $100 for the first day a violation occurs and $50 for each day thereafter in which the property has not been brought into compliance with the requirements of §§ 91.35 through 91.38 of this code.
(2) Second violation in 12 months. The second or subsequent violation of §§ 91.35 through 91.38 of this code for the same property, within a 12-month time frame, shall result in the property being declared a severe safety hazard and the owner fined a minimum of $250 up to $1,000, for each day the violation continues.
(3) Right to enter and remedy. If a violation continues for more than seven days after the person responsible for the condition of any the premises has been notified in writing of a violation of §§ 91.35 through 91.38 of this code, then the Board of Public Works and Safety may take steps necessary to bring the property(s) into compliance with §§ 91.35 through 91.38 of this code and all necessary cost incurred for that purpose shall be a charge against the owner of the affected property(s).
