509.10 CURFEW FOR JUVENILES.
   (a)   It shall be unlawful for any juvenile to be or remain in or loiter, idle, play or be present in or upon a public place, including but not limited to public streets, sidewalks, highways, roads, alleys, parks, playgrounds, parking lots and public grounds; business establishments; and public or private school grounds during the period ending at 5:00 a.m. and beginning the prior day:
      (1)   At 9:30 p.m. for a juvenile under the age of 12 years;
      (2)   At 11:00 p.m. for a juvenile between the ages of 12 and 16 years;
      (3)   At 1:00 a.m. for a juvenile between the ages of 16 and 18 years.
 
   (b)   The following shall constitute valid exceptions to the curfew:
      (1)   When the juvenile is accompanied by a parent or guardian;
      (2)   When the juvenile is accompanied by an adult, authorized by a parent or guardian to take the parent's place and accompany the juvenile for a designated period of time and purpose within a specified area.
      (3)   When the juvenile is on an errand as directed by a parent until the hour of 12:30 a.m.
      (4)   In the case of a medical or other emergency.
      (5)   In the case of reasonable necessity, but only after the juvenile's parent has communicated to the Chardon Police Department the facts establishing the reasonable necessity for not complying with the curfew, including the place where the juvenile is located, purpose, points of origin and destination and when the juvenile will return to his home.
      (6)   When the juvenile is on the sidewalk or property where the juvenile resides, or on adjacent property and the adult owner or resident of that property has given permission for the juvenile to be there.
      (7)   When a juvenile is traveling by a direct route without any unnecessary detour or stop to or from, and within one hour of, a scheduled school, religious or civic function or other organizational activity; from a place of public entertainment such as a movie, play or sporting event; or traveling to or from work.
      (8)   When authorized with a written permit issued by the Chardon Police Department carried on the person of a juvenile for a necessary nighttime activity not otherwise included in these exceptions.
      (9)   When the juvenile is married or has been married pursuant to State law.
 
   (c)   A juvenile violating this section shall be charged as unruly for violating the curfew ordinance and shall be subject to the legal procedures and punishments for juveniles as enacted under the laws of the State of Ohio.
