The applicant or property owner shall submit clear and convincing evidence to establish a nonconforming use of the lot, building, structure, or activity on the effective date of the Planning and Zoning Code or amendments thereto; or that a legally permitted use has since become nonconforming upon amendment of the Planning and Zoning Code. The Community Development Administrator shall issue a Certificate of Nonconforming Use if the applicant or owner sustains the burden of proof by clear and convincing evidence as required herein. The Certificate of Nonconforming Use shall state the reasons therefor; a description of the nature and extent of the use; dimensions or other means of identifying the portion of the building, structure or land devoted to the nonconforming use; and the measurements of the lot area, width or setbacks which are nonconforming.
