(a) Minor Misdemeanor. Whoever violates or fails to comply with any provision of this chapter, for which no penalty is otherwise provided, is guilty of a minor misdemeanor and shall be fined one hundred fifty dollars ($150.00) for each offense. The fine shall not be reduced or suspended. Each day during or on which a violation or noncompliance occurs or continues shall be deemed a separate offense.
(b) Failure to Obtain or Operate Without a License. Any person or entity which fails to apply for and obtain a license for an entertainment device arcade or an entertainment device as provided in this chapter is guilty of a misdemeanor of the fourth degree and shall be fined not more than two hundred fifty dollars ($250.00), or imprisoned not more than 30 days, or both, for each offense. The fine shall not be reduced or suspended. Each day during or on which a violation of noncompliance occurs or continues shall be deemed a separate offense.
