The developer or homeowners association of condominium, Planned Residential Development or other development with open spaces, streets, utilities, and other required improvements held in common or private ownership and not dedicated to public use, shall provide adequate funding for perpetual maintenance, repair and replacement of the open spaces, streets, utilities and other required improvements not dedicated to public use; deposit any maintenance guarantee required by Municipal regulations; shall include the requirements herein in the dedication of ownership and homeowners bylaws as a covenant running with the land referenced in each deed or other instrument of conveyance; and delineate the common areas and facilities in compliance with Section 1147.11, Requirements for Owners Associations.
