1123.19 DETERMINATION OF NONCONFORMING STATUS.
   The applicant or property owner shall submit clear and convincing evidence to establish a non-conforming use of the lot, building, structure, or activity on the effective date of the Planning and Zoning Code or amendments thereto; or that a legally permitted use has since become nonconforming upon amendment of the Planning and Zoning Code. The Community Development Administrator shall issue a Certificate of Nonconforming Use if the applicant or owner sustains the burden of proof by clear and convincing evidence as required herein. The Certificate of Non-Conforming Use shall state the reasons therefor; a description of the nature and extent of the use; dimensions or other means of identifying the portion of the building, structure or land devoted to the nonconforming use; and the measurements of the lot area, width or setbacks which are non-conforming.
