1111.027 EXTENSION TO DEADLINE.
   The applicant may file a written request with the Community Development Administrator for an extension before the expiration of a submittal filing deadline or construction deadline.
   (a)   A request for the first extension shall be made in writing to the Community Development Administrator. The Community Development Administrator may approve one submittal filing deadline and one construction deadline extension not to exceed three (3) months.
   (b)   For good cause shown, the Planning Commission may approve, approve with conditions or deny a second or additional extension for a submittal filing or construction deadline. An extension shall not exceed the length of time for compliance required by the Code.
   (c)   A development plan submittal or Construction Documents submittal shall comply with the municipal ordinances, standards and specifications in effect on the date the extension is requested unless a variance thereto is approved. Extensions shall be conditioned on the following:
      (1)   Any construction not yet started shall conform with the amended submittal.
      (2)   Any construction started, but not yet completed, shall be completed in conformance with the amended submittal.
      (3)   The subject project shall proceed in conformance with all applicable regulations in effect on the date the extension is granted.
      (4)   The developer shall comply with any special conditions of approval required by the Planning Commission.
   (d)    The Planning Commission may require terms and conditions of approval for compliance with the requirements in the Planning and Zoning Code and other applicable regulations.
