1501.12 RESIDENTIAL FIRE SPRINKLERS.
   (a)   Before a Municipal permit is issued for the construction of a one, two or three family dwelling, the person seeking the permit must demonstrate, upon a form provided by the City, that the person, or persons, for whom the dwelling is being constructed have been informed of the safety benefits of a residential fire sprinkler system and have been provided an offer to install such a system at the buyer's option and cost.
 
   (b)   Exceptions. Any one, two or three family dwelling constructed strictly as a speculative structure shall not be required to comply with the provisions of this section. This section is intended to apply where a one, two or three family dwelling is being constructed pursuant to a contract with the ultimate purchaser.
 
   (c)   Before a Municipal permit is issued for the construction of a one, two or three family dwelling wherein a residential fire sprinkler system is to be installed, the person seeking the permit must demonstrate, on a form provided by the City, that the system complies with the current standards of the National Fire Codes for residential sprinklers (National Fire Protection Association pamphlet, N.F.P.A. 13D).
 
   (d)   Any builder of a one, two or three family dwelling within the corporate limits of the City of Chardon, Ohio must provide adequate information to the original buyer of such dwelling in order for that buyer to make an educated decision regarding the purchase and installation of an optional residential fire sprinkler system. Such information must clearly and fairly explain the benefits of such a system and include a cost estimate for purchase and installation within the dwelling planned. Acceptable means of complying with this section could include one or more of the following:
      (1)   Brochures and system mock-ups.
      (2)   System displays in design centers or models.
      (3)   Installation of systems in model homes.
 
   (e)   The Fire Department will provide assistance as may be necessary to any builder of a one, two or three family dwelling within the corporate limits in obtaining information, system mock-ups, brochures and other educational materials which would be helpful in complying with paragraph (a) above.
 
   (f)   Failure to comply. Any contractor, builder, corporation or person who fails to comply with the requirements of this section shall not be granted any Municipal permits until there has been compliance with this section.
