923.175 SURCHARGES.
   (a)   Upgrade Surcharge: There is hereby levied and assessed upon each lot, parcel of land and premises within the corporate limits and having any active sewer connection with the sanitary sewerage system of the Municipality on or before April 20, 1993, or otherwise discharging sewerage, industrial waste, water or other liquids, either directly or indirectly into such system or any part thereof, an Upgrade Surcharge payable as provided in this section and in the amount determinable as follows:
      (1)   Surcharge for upgrade improvements: This surcharge is a proportionate share of the cost of the 1999 waste water treatment plant upgrades. The surcharge relates to the plant upgrade improvements set forth in the 1996 Sanitary Sewer Evaluation Study (or as thereafter adjusted and/or modified by City Council); and the cost to finance those improvements. The total upgrade surcharge, over the life of the financing term, reflects existing users' full proportionate share of the 1999 waste water treatment plant project costs.
      (2)   Monthly charge: This surcharge shall be in addition to the other rates and charges provided for in this chapter. This surcharge shall be a recurring monthly charge billed and payable as part of the regular monthly water and sewer billing. The Upgrade Surcharge shall continue until all costs associated with the 1999 waste water treatment plant upgrades have been paid. (Ord. 2737. Passed 9-13-12.)
      (3)   Rate: This surcharge shall be updated and billed at the following rates:

      (4)   The surcharges in subsection (a)(3) correspond to the billing/collections period for each calendar year. The surcharges will cease on June 30, 2021, when the last payment of the debt for the wastewater treatment plant is scheduled to be made.
      (5)   When necessary, the above rates shall be adjusted to correspond to the consumer's meter reading system.
      (6)   Use of upgrade surcharge:  
         A.   All funds collected shall be directly credited to the Water Pollution Control Loan Fund Capital Improvement Fund ("WPCLF Capital Improvement Fund") and used solely for the purposes identified in this Ordinance.
         B.   Funds collected as upgrade surcharges shall be used only for payment of waste water treatment plant upgrades.
         C.   Funds shall be construed as being expended in the order in which they are collected, in accordance with "First-In First-Out" principles.
         D.   In each fiscal period the Finance Director shall present to the City Council an annual report, describing the amount of upgrade surcharges collected, encumbered and used during the preceding year. Balances collected, including any accrued interest not encumbered in any fiscal period, shall be retained in the same WPCLF Capital Improvement Fund until the next fiscal period.
         E.   The upgrade surcharges shall be used, first, to retire WPCLF loan debt service which is pending for the year in which the upgrade surcharges were collected and which the City incurred to provide the waste water and treatment plant upgrades that accommodate existing development; second, to reimburse other accounts from which funds to finance WPCLF debt service were advanced; and, third, to pay other upgrade construction costs which are pending and which costs the City incurred, to provide waste water and treatment plant upgrades that accommodate existing development.
   (b)   Water Treatment Plant Surcharge: There is hereby levied and assessed upon each water consumer a surcharge to help fund the debt for the water treatment plant, as follows:

         D.   In each fiscal period the Finance Director shall present to the City Council an annual report, describing the amount of surcharges collected, encumbered and used during the preceding year. Balances collected, including any accrued interest not encumbered in any fiscal period, shall be retained in the WSRLA Debt Service Fund until the next fiscal period.
         E.   The surcharges shall be used, first, to retire water treatment plant debt service which is pending for the year in which the surcharges were collected; and second, to reimburse other accounts from which funds to finance water treatment plant debt service were advanced.
   (c)   Eastside Trunk Sewer Surcharge: There is hereby levied and assessed upon each sewer consumer a surcharge to help fund the debt for the eastside trunk sewer project, as follows:

      (2)   Monthly charge: This surcharge shall be in addition to the other rates and charges provided for in this chapter. This surcharge shall be a recurring monthly charge billed and payable as part of the normal monthly water and sewer billing. The Eastside Trunk Sewer Surcharge shall continue until all related debt costs have been paid.
      (3)   When necessary, the above rates shall be adjusted to correspond to the consumer's meter reading system.
      (4)   Use of funds:  
         A.   All funds collected shall be directly credited to the Eastside Trunk Surcharge Account within the WPCLF Debt Service Fund, and used solely for the purposes identified in this section.
         B.   Funds collected shall be used only for payment of the eastside trunk sewer debt.
         C.   Funds shall be construed as being expended in the order in which they are collected, in accordance with "First-In First-Out" principles.
         D.   In each fiscal period the Finance Director shall present to the City Council an annual report, describing the amount of surcharges collected, encumbered and used during the preceding year. Balances collected, including any accrued interest not encumbered in any fiscal period, shall be retained in the WPCLF Debt Service Fund until the next fiscal period.
         E.   The surcharges shall be used, first, to retire eastside trunk sewer debt service which is pending for the year in which the surcharges were collected; and second, to reimburse other accounts from which funds to finance eastside trunk sewer debt service were advanced.
   (d)   Surcharge for Sewage or Wastes above Normal Sewage Levels. Sewage or industrial wastes above normal sewage levels but acceptable for discharge into the sanitary sewerage system shall be subject to a surcharge. The surcharge shall be determined based on the amount of any, or all, of the following constituents of the water or waste which are in excess of the limits prescribed for each in the definition of normal sewage:
      Total suspended solids; and/or
      B.O.D.; and/or
      Phosphorus; and/or
      Ammonia-nitrogen
   The surcharge provided for herein shall be in addition to the other rates and charges provided for in this chapter. The pounds of B.O.D. per day, pounds of suspended solids per day, pounds of phosphorus per day, and pounds of ammonia-nitrogen per day, above the concentration previously described for normal sewage levels that are discharged to the sewerage system, shall be determined by the Municipality or an authorized representative.
   (e)   Additional Surcharge. In addition to the surcharges described herein, the Municipality shall have and reserves the right to surcharge any user for the discharge of any pollutant into the sewage system or for any other reason that it deems necessary and appropriate.
