Whoever violates any provision of these regulation or fails to comply with any order issued pursuant to these regulations shall be charged with, and subject to the penalties for, the following:
First offense: Minor misdemeanor.
Second offense: Fourth degree misdemeanor.
All offenses thereafter: First degree misdemeanor.
Each day upon which a violation occurs or continues shall be deemed a separate offense.
