The terms defined in this chapter shall have, throughout the Public Utilities Code, the meanings stated. When words used herein are defined in other regulations (including but not limited to the Zoning Ordinance, Street and Sidewalk Area Code, and Land Planning and Development Regulations) the words shall have the meaning therein defined. When words are not otherwise defined they shall carry their customary meanings as defined in Webster's Standard Dictionary. Words used in the singular include the plural; and the plural the singular. Words used in the present tense include the future tense. The word "shall" is intended to be mandatory. The word "may" is directive and to be complied with unless waived.
"Approved laboratory procedures" means the measurements, tests and analysis of the characteristics of water and wastes in accordance with analytical procedures determined acceptable by Federal guidelines as established in Title 40, Code of Federal Regulations, Part 136, or as approved by the Regional Administrator of the U.S. Environmental Protection Agency.
"Biochemical oxygen demand (or B.O.D.)" means the quantity of oxygen, expressed in mg/l, utilized in the biochemical oxidation of organic matter under standard laboratory conditions for 5 days at a temperature of 20 degrees centigrade. The laboratory determination shall be in accordance with approved laboratory procedures.
"Capital budget" means a separate budget dedicated to financing capital improvements.

"Development" shall mean any man-made change to improved or unimproved real property, the use of any principal structure or land, or any other activity that requires issuance of a site development permit and/or zoning permit.

"Development subareas" shall mean geographically defined areas of the Municipality that have been designated in the comprehensive plan as areas in which development potential may create the need for capital improvements program to be funded by impact fees.

"Development subarea map" shall mean a map of development subareas in which impact fees are imposed. This map is attached to this ordinance and incorporated by reference herein as if fully set out.

"Discharge" means the discharge of wastewater from premises at its point of entry in the sewerage system.
"Direct tap" means a connection to any Municipal utility system which is made directly into a water or sewer main dedicated to public use.
"Domestic waste": See "normal sewage".
"Drainage way" means any surface water drainage swale, drainage ditch, open channel waterway, receiving waterway, natural stream or water course, and any easement or right of way associated therewith.
"Enclosed storm sewer" means the entirety of sewer pipes, inlet basins, manholes, and other appurtenances install at, or below, grade for the collection and removal of storm water.
"Indirect discharge" means: 1. A discharge into any private service lateral or private sewer main, which lateral or main ultimately connects to a Municipal sewer system. 2. The discharge into any sewage or waste pretreatment facility, or any other sewage or waste processing system, which facility or system is connected to the Municipal sewerage system. 3. The introduction of pollutants into a publicly owned treatment works from any nondomestic source regulated under Section 307(b), (c), or (d) of the Federal Water Pollution Control Act (33 U.S.C. 1251, et seq.).
"Indirect tap" means any connection made to a private water or sewer pipe which ultimately connects to any Municipal utility system.
"Industrial waste" means the solid, liquid or gaseous wastes resulting from any industrial, manufacturing, trade or business process.
"Municipal storm sewer system" means the entirety of inlet basins, enclosed storm sewers, open drainage ways and receiving waterways planned, constructed, and/or designated to provide for the drainage of storm water from public properties and private storm sewer systems throughout the Municipality.
"Municipal storm water drainage plan" means the mapped and written portions of the Comprehensive plan regarding existing and proposed storm water drainage facilities.
"Normal sewage" means sewage which when analyzed shows by weight a daily average of not more than 250 parts per million of suspended solids; not more than 200 parts per million B.O.D.; not more than 8 parts per million phosphorus; and not more than 25 parts per million ammonia-nitrogen.
"Oils and greases" means those materials extractable from an acidified sample by freon or other acceptable solvent in accordance with approved laboratory procedures.
"Organic" means containing carbon compounds.
"Primary water line" is the service line within a structure which provides water for human consumption and use and which is discharged into the sanitary sewer system.
"Primary water line water meter" is the water meter which measures the water flowing through the primary water line.
"Private storm sewer system" means the entirety of drainage ways, inlet basins and enclosed storm sewers beginning at the point of discharge into the Municipal storm sewer system and continuing upstream onto a private property to the end of any open drainage ways upon said property. Said system serving the drainage needs of only the subject property.
"Receiving waterway" means any natural stream or watercourse designated by Council or the Planning Commission to receive the discharge from the Municipal storm sewer system and/or the Municipal wastewater treatment plant.
"Residential development" means any development approved by the local government for residential use.

"Sanitary sewer" means a sewer which carries domestic and/or industrial wastewater and to which storm, surface and ground waters are not admitted.
"Secondary water line" is the service line from the inside of the structure to an outside faucet or faucets and other water distribution devices, which provide water used solely outside of the structure and does not drain into the sanitary sewer system.
"Secondary water line water meter" is the water meter which measures the water flowing through the secondary water line.
"Service lateral" means a pipe connecting any water or sewer main with a user's building or facility.
"Sewer Main" means the piped portion of a sanitary sewer or storm sewer which receives the discharge from service laterals.
"Sewer tap-in permit" means the permit required for new user connections to the municipal sanitary sewer system.

"Sewage": See "normal sewage".
"Sewerage system" means all of the facilities required to transport sewage from the premises of the source to a sewage treatment facility, and includes the treatment and disposal facility. All such facilities of the Municipality shall be considered one such sewerage system.
"Sewer service charge" means the total charge to a sewerage system user.
"Site" means the land on which development takes place.

"Suspended solids" means solids that either float on the surface of, or are in suspension in, water, sewage or other liquids, and which are removable by laboratory filtering.
"User" means any person, corporation or other entity having, causing, or permitting the use of, an active user connection to a Municipal utility system.
"Wastewater" means a combination of liquid and water carried wastes.

"Water main" means the piped portions of the water distribution system which supply water to service laterals.

"User connection" means a connection to any Municipal utility system, whether by direct or indirect tap, whereby any person, corporation or other entity gains service from said system.
