In addition to the other requirements of this chapter, a development permit for a site located in a floodway shall not be issued unless the applicant first obtains a permit or written documentation that a permit is not required from DWR, issued pursuant to ILCS Ch. 615, Act 5 et seq. No permit from DWR shall be required if the Division has delegated responsibility to the village.
