§ 35.14 DEPUTY CHIEF.
   (A)   Creation of position. There is hereby created within the Police Department two positions of Deputy Chief.
   (B)   Qualifications and appointment.
      (1)   The position of Deputy Chief shall be an exempt rank in the Police Department and shall not be subject to the rules, regulations and authority of the Board of Fire and Police Commissioners.
      (2)   The Deputy Chief shall be appointed by the Chief of Police (the "Chief") and shall serve at the discretion of the Chief.
      (3)   The Chief may remove the Deputy Chief at any time.
      (4)   In the event that the Deputy Chief is removed from the position of Deputy Chief, he or she shall revert back to the rank currently held.
      (5)   In order to be eligible the office of Deputy Chief the person appointed must have been employed as a full-time sworn officer of the Police Department for five years.
      (6)   The Deputy Chief shall be permitted to take promotional exams and may be promoted to a higher classified rank than he or she currently holds without having to resign the position of Deputy Chief.
   (C)   Authority. The Deputy Chief shall be immediately below the Chief in the Department chain of command. The Deputy Chief has the authority to direct and issue orders to any members of the Department except the Chief.
