A. Prohibition: No person shall drive, operate, or be in actual physical control of any motor vehicle upon any highway who is under the influence of any substances included in the uniform controlled dangerous substance act 1 . The fact that any person charged with a violation of this provision is or has been lawfully entitled to use such controlled substance shall not constitute a defense.
B. Penalty: Any person who violates this section shall be guilty of an offense and, upon conviction thereof, shall be fined as provided in section 1-4-1 of this code. (1985 Code § 15-526)
