§ 90.02 EXTERIOR LIGHTING.
   (A)   This section shall apply to the control of external lighting within the limits of the Town of Chandler.
   (B)   The Town Council of the Town of Chandler, Warrick County, Indiana, deems it necessary to regulate the use of spot lights, flood lights and dusk to dawn type lighting as external lighting within the Town of Chandler to protect the best interests of the Town of Chandler and its citizens.
   (C)   No person shall install, utilize, and/or occupy real property utilizing external lighting of a type commonly known as flood lights, spot lights, and/or dusk to dawn type lights that are so positioned as to cast the light therefrom directly or indirectly onto the property of another.
   (D)   This section shall not apply to lighting utilized to illuminate any athletic, organized community events, or similar type events occurring on governmentally owned or maintained property.
   (E)   (1)   All fines and penalties shall be payable to the Town of Chandler Clerk-Treasurer. The Town of Chandler Clerk-Treasurer is the Town of Chandler Violations Clerk and shall receive all payment of penalties under this section for which the violator desires to waive trial and admit the violation.
      (2)   All cases wherein persons cited for a violation do not waive trial and admit the violation or default in appearance before the Town of Chandler Clerk-Treasurer shall be referred to the Town Attorney for filing with the appropriate court in Warrick County, Indiana.
   (F)   This section shall be effective upon its passage and publication as is by law required.
