(A) Prohibition of illicit discharges. No person shall throw, drain, or otherwise discharge or cause to throw, drain, run, or allow to seep or otherwise be discharged into the Town of Chandler MS4 any materials, including but not limited to pollutants or waters containing any pollutants, other than storm water not meeting the definition of a storm water nuisance. The commencement, conduct or continuance of any illicit discharge to the Town of Chandler MS4 is prohibited. The following are exempt from the prohibition provision above:
(1) Water line flushing performed by a government agency, other potable water sources, landscape irrigation or lawn watering, diverted stream flows, rising ground water, ground water infiltration to storm drains, uncontaminated pumped ground water, foundation or footing drains (not including active groundwater de-watering systems), crawl space pumps, air conditioning condensation, springs, non-commercial washing of vehicles, natural riparian habitat or wetland flows, pump sump discharge, and any other water source not containing pollutants and not causing a storm water nuisance;
(2) Dye testing, only when written notification is given to the Town of Chandler Storm Water Department Manager prior to the time of the test;
(3) Discharges or flows from fire fighting;
(4) Other discharges as specified in writing by the Storm Water Board or its designee as being necessary to protect public health and safety; provided, however, if the SW Board or its designee finds that any exemptions previously granted are causing adverse impacts to water quality, then the Storm Water Board or its designee shall have the authority to rescind the exemption on a case-by-case basis and regulate the discharge under the provisions of this subchapter; and
(5) The prohibition shall not apply to any non-storm water discharge permitted under an NPDES permit, waiver, or waste discharge order issued to the discharger and administered under the authority of the state and federal Environmental Protection Agency, provided that the discharger is in full compliance with all requirements of the permit, waiver, or order and other applicable laws and regulations, and provided that written approval has been granted by the Town of Chandler for any discharge to the Town of Chandler MS4.
(B) Prohibition of illicit connections. The construction, connection, use maintenance or continued existence of any illicit connection to the Town of Chandler MS4 is prohibited.
(1) This prohibition expressly includes, without limitation, illicit connections made in the past, regardless of whether the connection was permissible under law or practices applicable or prevailing at the time of connection.
(2) A person is considered to be in violation of this subchapter if the person connects a line conveying sewage to the Town of Chandler MS4, or allows such a connection to continue.
(3) Improper connections in violation of this division must be disconnected and redirected, if necessary, to the sanitary sewer system upon directive of the Town of Chandler Storm Water Department Manager or the Town of Chandler Wastewater Department.
