§ 52.22 GENERAL PROVISIONS.
   (A)   Purpose and intent. The purpose of this subchapter is to provide for the health, safety, and general welfare of the citizens of Chandler through the regulation of non-storm water discharges to the Town of Chandler separate storm sewer system to the maximum extent practicable as required by federal law. This subchapter establishes methods for controlling the introduction of pollutants into the Town of Chandler separate storm sewer system in order to comply with requirements of the National Pollutant Discharge Elimination System (NPDES) permit process. The objectives of this subchapter are:
      (1)   Regulate the contribution of pollutants to the Town of Chandler separate storm sewer system by any user;
      (2)   Prohibit illicit connections and illegal discharges to the Town of Chandler separate storm sewer system;
      (3)   Control discharges to the Town of Chandler separate storm sewer system of spills, dumping or disposal of materials other than storm water; and
      (4)   To establish legal authority to carry out all inspection, surveillance and monitoring procedures necessary to ensure compliance with this subchapter.
   (B)   Applicability. This subchapter shall apply to all water entering the Town of Chandler separate storm sewer system generated on any developed and undeveloped lands unless explicitly exempted by the Town Council or its designee.
   (C)   Compatibility with other regulations. This subchapter is not intended to interfere with, abrogate, or annul any other ordinance, rule or regulation, statute, or other provision of law. The requirements of this subchapter should be considered minimum requirements, and where any provision of this subchapter imposes restrictions different from those imposed by any other ordinances, rules or regulations, or other provisions of law, whichever provisions are more restrictive or impose higher protective standards for human health or the environment shall be considered to take precedence.
   (D)   Responsibility for administration. The Town Council of Chandler and/or the Environmental Department Manager shall administer, implement, and enforce the provisions of this subchapter.
