§ 94.47 WRITTEN DETERMINATIONS.
   In a written determination issued under this subchapter, the town shall state clearly the basis for the decision to approve or deny an application. In the event that the application is denied, the written notice must include substantial evidence in support of the denial. A notice is considered written if it is included in the minutes of a public meeting of the town, submitted as public communication or report, sent via USPS, or transmitted via electronic mail. If the town fails to act on an application within the applicable deadline as proscribed in this subchapter, the application is considered approved.
