§ 73.36 APPLICATION; REQUIREMENTS; PERMIT ISSUANCE; CONDITIONS.
   (A)   (1)   The applicant must be 18 years of age or older.
      (2)   The applicant must be an owner of property within the corporate limits of the village or within its one mile jurisdiction.
      (3)   The applicant’s license to operate a motor vehicle is not currently suspended or revoked by the laws of the state for loss of points or driving under the influence of alcohol or other similar driving offenses, causing a revocation or suspension of said person’s operators license.
      (4)   The applicant must submit a proof of financial responsibility evidencing the applicant’s ability to respond in damages for liability, on account of accidents occurring subsequent to the effective date of such proof, arising out of the ownership, maintenance or use of said cart:
         (a)   In an amount of not less than $25,000 due to the death of one person in any one accident, and subject to such limit for one person;
         (b)   To a limit of not less than $50,000 due to the death of two or more persons in any one accident; and
         (c)   To a limit of not less than $25,000 because of injury to or destruction of property of others in any one accident.
      (5)   The applicant shall acknowledge that he or she shall abide by the terms and conditions of this subchapter.
      (6)   A non-refundable annual application fee of $10 shall accompany each application.
      (7)   The applicant shall pay for all other expenses and costs associated with the application.

   (B)   Upon satisfaction of the above conditions, the Village Clerk may issue a permit for such person to operate a golf cart on the streets of the village under the following rules and regulations.
      (1)   Said permit is valid for the calendar year in which it is issued, January through December, subject to impoundment and/or revocation.
      (2)   The applicant and/or operator shall operate such golf cart subject to the following.
         (a)   The operator shall possess a valid Class O operator’s license or a valid provisional operator’s permit.
         (b)   Said golf cart shall not be operated within the corporate limits of said village between sunset and sunup of the subsequent day.
         (c)   Said golf cart shall not be operated at a speed in excess of ten mph.
         (d)   The maximum occupancy of a golf cart shall be one person per seat or as recommended by the manufacturer. All passengers must remain seated while the cart is in operation.
         (e)   Maintain at all times the proof of financial responsibility as required above.
         (f)   All golf cart requirements as stated in § 73.35 of this chapter shall apply.
